GENERAL TERMS AND CONDITIONS FOR ONLINE SALES ON THE SHOP.ALMARJESOLO.COM WEBSITE
The general conditions of sale and use transcribed below (hereinafter only "General Conditions") apply to all sales (hereinafter referred to as "Services" or individually "Service") provided by Almar Jesolo Resort & Spa, through its www.shop.almarjesolo.com domain.
The use of services is permitted only to a registered user who has:
- Read the Information concerning the processing of personal data;
- Accepted the General Conditions;
- Created a personal account.
Pursuant to Legislative Decree n. 70, 9.4.2003, Almar Jesolo Resort & Spa provides users with the following information: the supplier of services subject to the General Conditions is HNH Hospitality S.p.A., with registered offices in Mestre Venice Trinity Palace - Via Saragat, 1 - 30174 Italy, Tax code, VAT and Venice Business Register enrollment number 03978470270; certified email (PEC)hnhspa@pec.hnh.it, registered capital of 572.033,00 i.v. Euros.
Throughout this document HNH Hospitality S.p.A. will be referred to as Almar Jesolo Resort & Spa, which is the trade name under which the company conducts its online business.
GENERAL INFORMATION AND SCOPE OF APPLICATION
These General Sales Conditions are governed by the Consumer Code (Legislative Decree no. 206/2005 and subsequent amendments) and by the regulations on electronic commerce (Legislative Decree no. 70/2003 and subsequent amendments) and apply exclusively to the online sale of products displayed on the website www.shop.almarjesolo.com
The General Conditions may be modified at any time, subject to the user's right of withdrawal as follows. Any changes and\or new conditions will be in force from the moment of their publication in the "Terms and Conditions" section of the Website. To this end, we encourage users to regularly access the Website and to verify the publication of the most current version of the Terms and Conditions.
The applicable General Conditions are those in force on the date of submission of the purchase order.
In the event that the user does not wish to accept the changes to the General Conditions he shall be entitled to withdraw by giving notice by registered letter with return receipt or by certified e-mail (PEC) with 7 days notice.
SIGN UP
Registration on the website is free. To register, users must fill out the registration form by entering their name, a valid email address and a password (hereinafter the "Registration Credentials"). A confirmation email will be sent to the email address provided by the user.
In the "My Account" area of the website users can view open orders, recently shipped and/or completed orders and manage and store personal data.
Almar Jesolo Resort & Spa reserves the right to reject, in its sole discretion, any request for registration. Almar Jesolo Resort & Spa also reserves the right to reject any order of unusual size or unusual purchase frequency made on the Website.
Users may cancel at any time their subscription to the Almar Jesolo Resort & Spa website by sending an email to almablu@almarjesolo.com
PRE-CONTRACT DISCLOSURE
In accordance with Legislative Decree 9 April 2003, n. 70 laying down provisions concerning electronic commerce, Almar Jesolo Resort & Spa informs users that:
To complete the purchase of one or more products on the Website, users must fill in an electronic order form and send it to Almar Jesolo Resort & Spa, by Internet, following the step-by-step instructions that appear on the Website during the purchase process;-
The contract is concluded when Almar Jesolo Resort & Spa records the order form, after verifying the accuracy of order and payment information;
After registering the order form, Almar Jesolo Resort & Spa will send a confirmation e-mail to the email address provided by the user with a summary of the General Conditions, the order number, information on characteristics of product purchased, detailed information on price, method of payment used, the procedures to follow in order to exercise the right of withdrawal, shipping and handling costs and any additional fee and Customer Service contact information. This e-mail must be kept as proof of purchase or stored in a durable medium;
The order form will be filed in Almar Jesolo Resort & Spa's database for the time needed to execute the order and, in any event, in accordance with law. To access the order form users can go to the "My account - 'My Orders" section on the Website to view the list of all orders placed.
Almar Jesolo Resort & Spa reminds Customers to check with the utmost attention and care the accuracy of data contained in the Order Confirmation and notify Almar Jesolo Resort & Spa of any corrections within 24 (twenty four) hours of receiving it. The Order Number, generated by the system and notified by Almar Jesolo Resort & Spa, will be used by the Customer in any communications with Almar Jesolo Resort & Spa.
PURCHASE TERMS AND CONDITIONS
Products and prices displayed on the Website constitute an offer to the public in accordance with the procedures set out in the General Conditions and in the Website. The conditions of this offer only apply to purchases made on the above indicated website. The purchasing contracts stipulated on the Website and concerning the Products are concluded with HNH Hospitality S.p.A.
All prices listed on the site are expressed in Euros (€) and are inclusive of VAT. Shipping costs are charged to the Customer and explicitly indicated. This amount is inclusive of VAT and will be shown separately on the order form prior to shipping and on the e-mail order confirmation.
Customers will be charged the price of the product indicated on the Site at the time the order is sent, without taking into account any previous offer or any price change made subsequently. Products shall remain the property of Almar Jesolo Resort & Spa until the purchase price and any applicable fees have been fully paid by the user.
Almar Jesolo Resort & Spa shall process the purchase order only after the payment of the total amount due, consisting of purchase price, shipping costs and any additional charge, as indicated on the order form, has been confirmed.
PAYMENT METHODS
All the characteristics of the products, including selling price, are displayed on the website and visible during the order entry process and before the purchase is concluded. All sale prices include VAT.
Payment of products purchased on the Website can be made using any of the following methods:
Credit cards: Visa, American Express, MasterCard, DinersClub, JCB, CartaSi, processed through a secure connection
Paypal allows you to pay with your credit card / prepaid card or through your Paypal account (rechargeable via bank transfer or credit card/prepaid card). Paypal does not entail any additional costs to the customer.
For transaction security reasons, Almar Jesolo Resort & Spa reserves the right to ask for a copy of the credit card holder's identity document. Customers will be charged the total amount due at the time of Order Confirmation.
Almar Jesolo Resort & Spa will issue an invoice against the Purchase Order, and send the original copy with the products purchased to the address provided by the Customer. When issuing the invoice, the information provided by the customer will prevail. Almar Jesolo Resort & Spa therefore reminds Customers to always check with the utmost attention the accuracy of the information provided.
AVAILABILITY
The products offered on the Website are limited in number and can be sold at discounted prices. It may therefore happen that the ordered product is no longer available after the purchase order has been registered. If the product ordered is unavailable, the user will be promptly notified by e-mail and the purchase order will be canceled. If payment has already been made, Almar Jesolo Resort & Spa will refund the amount paid by the user, including any fees for order fulfillment and shipping costs, immediately, and, in any event, within a thirty-day period starting from the day after the order was submitted. The refund will be communicated via e-mail, and credited back using the original payment method or by bank transfer.
Almar Jesolo Resort & Spa accepts no responsibility for any delay in crediting the payment, which may be caused by the bank or type of credit card used for payment.
DELIVERY METHODS
Orders will be delivered by carriers specially designated by Almar Jesolo Resort & Spa.
We only offer delivery within the European Union, to the postal address provided by the Customer on the order form.
The expected delivery times are those indicated in the website's "Payment" and "Shipping" sections, in any event no later than 30 (thirty) days from the order date.
Deliveries are made from Monday to Friday, during office hours, except on national holidays.
In case of impediments to the delivery due to unforeseen circumstances, Almar Jesolo Resort & Spa shall not be held in any way responsible for any delay due to acts of third parties and/or unforeseen circumstances.
The delivery is considered completed when the product is handed over to the customer at the address specified on the order form.
In the event that the package shows visible signs of tampering or alteration, the customer must report the issue by email to almablu@almarjesolo.com and return the goods no later than 30 days from the date the email was sent.
SHIPPING COSTS
Delivery costs are charged to the customer and properly highlighted and listed in the Purchase Order and subsequent order confirmation.
Shipping costs depend on the destination country, as follows:
- Italy € 10.00 - Free shipping on orders over 150 €
- Europe € 30.00 - Free shipping on orders over 150 €
CUSTOMER SUPPORT FOR INFORMATION AND COMPLAINTS
The Customer may inquire about Support Services, including after sales support, or forward any complaint by contacting Almar Jesolo Resort & Spa using the channels listed in the "Contact Us" section of the Website.
RIGHT OF WITHDRAWAL
If the Customer is a "Consumer", as defined in Article 3 of the Consumer Code, he shall be entitled to the rights set forth in art. 52 et seq. of the Consumer Code, as amended by Legislative Decree no.21 of 02/21/2014, and therefore to the right to terminate the Purchase Agreement for any reason, without explanation and without penalty, in the manner set out below. The withdrawal can apply to all (Total Withdrawal) or part of (Partial Withdrawal) the products purchased by the customer on the website.
The user has the right to withdraw the contract, without giving any reason, within 14 (fourteen) days from the day when you or a third party other than the carrier and indicated by you acquires physical possession of the last good.
The right of withdrawal is exercised by sending - before the expiration of the Withdrawal Period as indicated above - a notice of withdrawal by registered mail with return receipt addressed to:

The notice of withdrawal must specify the intention to withdraw from the Purchase and the product/products for which you wish to exercise the right of withdrawal, the order number and the customer data.
In order to receive a refund, goods must be returned to the following address:

without undue delay and in any event within 15 (fifteen) days from the date on which you informed us of your intention to withdraw from this contract.
Almar Jesolo Resort & Spa reminds its customers that, in case of withdrawal, shipping costs incurred when returning the product/products shall be borne by the consumer and that the return is under the customer's full responsibility. Almar Jesolo Resort & Spa also recommends its consumers to check that the product/products they are returning are intact and in their original condition, in their original box, with all of their parts (including packaging and supporting documents).
The right of withdrawal may be exercised only if the goods are perfectly intact in all their parts and unused. Therefore, returned packages must be unopened, with their wrapping still intact, and in untampered-with condition. If the goods returned are deemed to have been damaged or tampered with, HNH Hospitality S.p.A. will not refund the amount paid for the purchase of products.
If the right of withdrawal has been properly exercised in accordance with the provisions of articles 52 et seq., Almar Jesolo Resort & Spa will refund the customer the full amount paid, inclusive of delivery charges and any and all additional costs incurred, within 15 (fifteen) days from the day that Almar Jesolo Resort & Spa physically receives the returned merchandise.
The amount will be refunded by the same method of payment used by the customer for the initial transaction, unless otherwise expressly requested by the consumer and provided that the consumer does not incur any fees as a result of the refund.
Almar Jesolo Resort & Spa shall not be responsible for any delay in crediting the payment, which may be caused by the bank or type of credit card used for payment
